According to the Census Bureau's definition of this code, the products are "typically protected in their selection, arrangement and/or presentation." The contracts under this NAICS may be for the following kinds of products:

  • Mailing addresses,
  • Telephone directories,
  • Directories of businesses,
  • Collections or compilations of proprietary drugs or legal case results,
  • Compilations of public records, etc.

This NAICS was previously represented by two Standard Industrial Classification (SIC) codes, 2741 and 7331. These codes covered a several topics, as listed below:

The size standard associated with NAICS 511140 is 500 employees.

Total reported spending under NAICS 511140 in FY03 was over $62 Million. FY04 saw a dramatic decrease, to almost $19 Million. (Source: epipeline's FPDS information, covering fiscal years 2003 and 2004 - please note, new information about contracts past and present is updated on a quarterly basis).

WHO ISSUES THE CONTRACTS?

The United States Navy was the largest buyer for these services in FY04, by a significant margin, with over $6.8 Million in contract spending, comprising over 36% of the market share. The National Institutes of Health (NIH) was not too far behind, with $5.8 Million and 30% of the market share. In FY03, the Patent and Trademark Office (PTO aka USPTO), topped the list with almost $40 Million. There were no contract dollars listed in FPDS under NAICS 511140 in FY04.

The United States Army, third on the list, had a significantly smaller market share, with over 6%, equating to $1.2 Million. The combined market share for the top ten agencies/departments exceeded 94%.

WHO WINS THE CONTRACTS?

According to the Central Contractor Registry (CCR), there are 463 companies registered under NAICS 511140 (source: active registrants, www.ccr.gov as of 5/25/06). 368 of those are small businesses. The two charts below identify the top 10 Companies, by market share, for FY04. The first chart represents the top 10 companies that were awarded their contracts under ANY type of competition, whether it was full and open, small business set-aside, sole-sourced, etc. This list primarily consists of large businesses. The second chart, however, lists the top 10 companies that won their contracts under RESTRICTED competition. Specifically, epipeline limited this to those contracts awarded under the following acquisition strategies:

  • 8(a) Competed
  • 8(a) Small Disadvantaged (SDB) set-aside
  • 8(a) sole-source
  • SDB set-aside
  • SDB, 8(a) with HUBZone
  • Combination HUBZone and 8(a)
  • HUBZone set-aside
  • HUBZone sole-source
  • Service Disabled Veteran-Owned Small Business (SDVOSB) set-aside
  • SDVOSB sole-source
  • Emerging Small Business set-aside
  • Very Small Business set-aside
  • Reserved for Small Businesses ($2501 to $100,000)
  • Total Small Business set-aside

The College of American Pathologists holds the top spot on the unrestricted competition list, with $4.8 Million in contract dollars for FY04 and over 25% of the market share. Lloyd S. Maritime Information was a close second, with 24% of the market share, equating to over $4.5 Million. It is a significant drop-off for the remaining firms on the top ten list. Both Omnitec Solutions, Inc., and Doane Marketing Research Inc. have over $1 Million in reported contract dollars. FY04 listed 19 companies holding contracts with at least $100,000 in contract dollars.

Omnitec Solutions, Inc., tops the "restricted" competition list by an overwhelming margin. The reported contract dollars for their contracts totaled over $1.2 Million in FY04 for contracts with a specific acquisition strategy. Thomson Healthcare, Inc. also appears on both lists, though with unrestricted/unreported acquisition strategy, their contracts totaled over $500,000, whereas within the restricted competition, the reported contract spending was just under $25,000. The total contract spending for ALL contracts in FY04 under reported restricted competition was just under $1.6 Million.

HOW ARE THESE CONTRACTS PROCURED?

Full and Open (unrestricted) competition represented over 40% of contract dollars under NAICS 511140 in FY04, with over $7.6 Million in contract spending. Small Business set-aside procurements totaled $1.4 Million and contracts that were sole sourced to 8(a) firms was an additional $118,000. The largest segment, however, were not categorized under a specific acquisition strategy. These contracts, with spending almost $10 Million in FY04, cover all strategies, from unrestricted competition, to possible HUBZone or SDVOSB sole source projects. As contracting offices get familiar with the new reporting methods for contract history data, the number contracts with an "unknown" acquisition strategy should shrink.
